Limited Warranty
Diamond Cargo, LLC (“Warrantor”) warrants to the original consumer purchaser that for a period of five (5) years from the date of purchase by purchaser that the trailer manufactured by Warrantor, as detailed below, shall be free of defects in materials and workmanship attributable to Warrantor. This 5-year warranty does not include electrical, plumbing, windows, doors, sealant, paint, undercoating, roof, all exterior metal, and fiberglass parts, which are warranted for a one (1) year period from the date of purchase by the original purchaser.
Voiding of Warranty/Excluded From Warranty
Should the trailer be altered, changed or modified in any manner whatsoever after manufacture, or should repairs or work be performed on the trailer that is not expressly authorized by Warrantor in writing, this Warranty shall be NULL AND VOID and all of the obligations of Warrantor hereunder shall cease immediately. Additionally, Warrantor is not responsible for claims related to: (1) defacing, scratches, dents, chips, or tears on any surface that were not caused by Warrantor; (2) routine maintenance; (3) damage from unauthorized repairs, abuse, misuse, or neglect; (4) damage caused by improper hitch ball or tow hook up; or (5) component parts covered by separate supplier warranty. Warrantor reserves the sole right for final determination whether a product has been changed, modified, altered, repaired, abused or misused such that the terms of this provision apply.
Warrantor's Obligation
Warrantor shall elect to remedy defects in materials and workmanship caused by Warrantor, by repair or replacement. Refunds may be allowed only if replacement or repair are not possible. All defective products shall be delivered to Warrantor’s address below unless prior written approval is obtained from Warrantor. Warrantor may select another qualified location for the repair to be completed. Warrantor will not be obligated, in any way, to pay for repairs made without its specific approval. All cost incurred in shipping or delivery of products for warranty service shall be borne by purchaser. Warrantor shall remedy defects within a reasonable time, not to exceed sixty (60) days after delivery by purchaser.
Purchaser's Obligation
Purchaser must complete and return the warranty card below to the address for Warrantor below within fifteen (15) days of purchase to obtain warranty service. Purchaser must notify Warrantor of any defects within fifteen (15) days after the defect is, or should have been, discovered in order for this warranty to apply. Purchaser must pay all service, towing, and transportation charges incurred to obtain warranty service pursuant to this warranty.
Shipping, Delivery, and Other Freight Charges
Purchaser is responsible for all costs incurred in shipping or delivering products for service under this warranty. Warrantor is not responsible for charges related to shipping, delivery, or any other freight charge associated with a Warranty claim by a purchaser. Should any purchaser or dealer incur shipping or freight charges related to a warranty claim, the purchaser or dealer shall be solely responsible for the same.
Disclaimer of Consequential and Incidental Damages
The original purchaser of Warrantor's product, any person to whom the product is transferred, and any person who is an intended user or beneficiary of the product, shall not be entitled to recover from Warrantor any consequential or incidental damages resulting from any product defects, including loss of trailer, revenue, or other commercial loss, use of rental equipment or loss of time and convenience.
Limitation and Disclaimer of implies Warranty
Warrantor expressly limits the duration of all implied warranties of merchantability, fitness for a particular purpose and other implied warranties to the warranty period of five (5) years. The Warrantor expressly disclaims all implied warranties after expiration of the warranty date. No individual has the authority to expand, amend, or modify this warranty.
Design Change
Warrantor reserves the right to modify the design of its products from time to time without notice or obligation to make corresponding changes to previously manufactured products.
This warranty gives you specific rights. No action to enforce this warranty shall be commenced later than six (6) months after the discovery of any defect or after the expiration date of warranty period.
